Our analysis has formed the basis for Claim Submissions, reports for mediation, and Expert Reports for trial and arbitration for projects throughout Canada and in Iran, Honduras, the United States, Pakistan, United Kingdom, New Zealand, U.A.E and Turkey.

Expert Services

Since 1993 we have provided Expert Reports addressing a wide range of construction related matters. For those rare cases which have “gone the distance” we have provided Expert Testimony at trial or arbitration hearings in Ontario, New York, New Jersey and Michigan in matters of project management, construction management, construction contracting procedures, project cost control, internal cost accounting practices, construction company operations and the quantification of losses and damage experienced by Contractors in both delay and deferral situations.

Construction Claim Preparation

Our primary aim through the analysis and preparation of our client’s claim submissions is to provide the best opportunity to resolve disputes at a reasonable and balanced level.  This is only achieved through rigorous analysis of all project information, good and bad, allowing both parties to – sometimes reluctantly – accept reality.  It is our view that legal recourse must be reserved for those rare occasions when non-construction factors prevent negotiated resolution.

Claim Defence Management

Emotions run high between the parties in a construction dispute – often so high as to inhibit otherwise achievable settlement.  Pearson Consulting provides practical and objective assessments of the validity of claims raised against the Owners, Developers and General Contractors, and works with client counsel in the development of defence strategies, rebuttal submissions and negotiation support.

Planning and Scheduling

The practical construction management experience of our personnel enables us to provide detailed early planning services for our client’s major construction projects.  We speak the same language as client Project and Construction Managers which leads to the preparation of fully compliant, quality baseline and bid schedules.  When requested, Pearson Consulting also provides progress updates and associated progress reporting narratives – all based upon our own site observations and discussions with subtrade and client personnel.  Our staff are fully conversant operators of Oracle Primavera P6 and its predecessors, with Microsoft Project and a variety of time chainage software.

Cost Control

“Cost Control” comprises three main elements: Incurred Cost is the money spent; Committed Cost representing all awarded Purchase Orders and Contracts; Projected Costs being the estimate of final cost at any point in the project cycle.  In order that control can be achieved, each of these elements must be routinely studied, understood and adjusted as the project proceeds and compared against the bid / contract estimate.  Pearson Consulting assists our client through the provision of the following services: quantity take-off and costing for bid submissions; establishment of practical cost code structures; quantity measurement of work completed; guidance for incurred and committed cost collection; continuous cost projections; independent Expert Reports and Testimony on all aspects of construction estimating and cost reporting / control.

Process Control Improvements

As our construction clients grow or take on new lines of business, those control processes which previously worked well, may become inadequate and unable to control the increased risk.  Pearson Consulting acts as a facilitator in such instances, leading the clients PM / Admin / CM staff in the development of project controls and responsibilities which best suit the clients new needs.  In some cases project control can be improved by one or more individual presentations on such subjects as Control of Changed Scope, Daily Reporting, Cost Coding / Collection / Reporting, Notice of Delay or Control Responsibilities.  Such presentations can be tailored to client’s specific needs and can be a most positive step in increased risk awareness within the client’s team.
